The Schenck Ruling by Chief Justice Oliver Wendell Holmes

The Schenck Ruling by Chief Justice Oliver Wendell Holmes Charles Schenck was the general secretary of the Socialist Party in the United States. During World War I, he was arrested for creating and distributing pamphlets that urged men to assert your rights and resist being drafted to fight in the war. Schenck was charged with attempting to obstruct recruitment efforts and the draft. He was charged and convicted under the Espionage Act of 1917 that stated that people could not say, print, or publish anything against the government during times of war. He appealed to the Supreme Court, claiming the law violated his First Amendment right to free speech. Chief Justice Oliver Wendell Holmes The former Associate Justice of the Supreme Court of the United States was Oliver Wendell Holmes Jr. He served between 1902 and 1932.  Holmes passed the bar in 1877 and started working in the field as a lawyer at a private practice.  He also contributed editorial work to the American Law Review for three years, where he subsequently lectured at Harvard and published a collection of his essays called The Common Law.  Holmes was known as the Great Dissenter at the U.S. Supreme Court due to his opposing arguments with his colleagues. Espionage Act of 1917, Section 3 Following is the pertinent section of the Espionage Act of 1917 that was used to prosecute Schenck: Whoever, when the United States is at war, shall willfully make or convey false reports of false statements with intent to interfere with the operation or success of the military..., shall willfully cause or attempt to cause insubordination, disloyalty, mutiny, refusal of duty..., or shall willfully obstruct the recruiting or enlistment service of the United States, shall be punished by a fine of not more than $10,000 or imprisonment for not more than twenty years, or both. Supreme Court Decision The Supreme Court led by Chief Justice Oliver Wendell Holmes ruled unanimously against Schenck. It argued that, even though he had the right to free speech under the First Amendment during peacetime, this right to free speech was curtailed during the war if they presented a clear and present danger to the United States. It is in this decision that Holmes made his famous statement about free speech: The most stringent protection of free speech would not protect a man in falsely shouting fire in a theater and causing a panic. Significance of Schenck v. the United States This had a huge significance at the time. It seriously lessened the strength of the First Amendment during times of war by removing its protections of the freedom of speech when that speech could incite a criminal action (like dodging the draft). The Clear and Present Danger rule lasted until 1969. In Brandenburg v. Ohio, this test was replaced with the Imminent Lawless Action test. World History Essay Buddhism was founded in India during the 6th century and brought to China by the first century. Buddhism spread widely and cause china to have a period of political instability and disunity, but then later restored the imperial structure. By going from India to China, it had mixed results. Many Chinese accepted Buddhism and defended it while other observed Buddhism’s absence from past texts and used it as an excuse for political and social problems. Still others remained indifferent hoping that it would all work itself out and develop into a unified Chinese culture. Documents 2 and 3 defend and encourage Buddhism while 4 and 6 scrutinize and discourage its spread. Documents 1 and 5 neither encourage or discourage the religions spread, they simply state how it should be dealt with. An additional document that would be helpful would be a chart or graph that showed the number of people who converted to Buddhism. It would be helpful to see which group of documents was correct or who was just over-reacting. Documents 2 and 3 defend and support the spread of Buddhism. Document 2 speaks of the many joys, including Nirvana, of joining Buddhism. However, the author, Zhi Dun is part of the upper class and does not have a point of view from the lower class, which made up most of the population. Document 3 counters the scrutiny of anti-Buddhists with logic. However, since the author is anonymous, his influence in the document is difficult to pinpoint, yet his role as a scholar certainly dictates a slight upper class position, just like document 2. Documents 4 and 6 both discourage the spread and use of Buddhism. Document 4 ridicules Buddhism as â€Å"a cult of barbarian peoples,† saying how Confucianism is all truth and Buddhism is all lies. Of course Han Yu’s position in the imperial court makes his opinions 20 times more powerful than any peasants. Document 6 blames Buddhism for all of the problems in Chinese society. Since the author is Emperor Wu himself, it is very likely that his opinions carried a lot of importance in his nation, even though people sometimes adopt prohibited acts merely in attempt to rebel against the law. Documents 1 and 5 neither encourage or discourage Buddhism’s spread in China, but attempt to negotiate. Document 1 is directly from the Buddhist tradition, laying down the basic laws and guides to a happy and enlightened life. Since the document is taken straight from sacred texts, it was most likely the beliefs of all Buddhists. Document 5 attempts to make a compromise among the conflicts of belief systems in China. Although Zong Mi’s intentions may seem fair, he himself is a Buddhist scholar, so his ideas might just be an effort to defend Buddhism. The spread of Buddhism in China during the first century was met with different aspects and ideas. Many Chinese accepted Buddhism and defended it, as in documents 2 and 3, while other observed Buddhism’s absence from past texts and used it as an excuse for political and social problems, like documents 4 and 6. Jefferson and Blake Writers of the Enlightenment and the Romantic Era The Enlightenment and the Romantic Era are two periods that differed greatly. Out of these contrasting eras came different literary styles and purposes. Thomas Jefferson and William Blake are two primary examples of diverse authors from equally diverse eras. Although the Romantic Era grew alongside the Enlightenment, it placed value on emotion or imagination over reason, where as the Enlightenment focused on reason and logical thinking. Unlike the Enlightenment, Romanticism allowed people to get away from the constricted, rational views of life and concentrate on an emotional and sentimental side of humanity. This not only influenced political doctrines and ideology, but was also a sharp contrast from the Enlightenment’s embracing of rationality before emotion. Jefferson and Blake both representing their own era through different writing styles that characterized the era in which their writings belong. Along with Enlightenment came European struggle with the monarchy. This led to ideas of a self-governed people and, along with the separation of individuals from religion and government, would inevitably influence Thomas Jefferson’s writing of The Declaration of Independence. The beliefs in equality, justice, and morals were outstanding ideas from the Enlightenment that moved Jefferson to write in the instructive manner in which his purpose was to lead a group of people to believe in â€Å"life, liberty, and the pursuit of happiness.† The Enlightenment influenced Jefferson’s writings and was responsible for his instructive writing style. William Blake’s writing style was a product of the Romantic Era in which people were more concerned with emotions than reason. This era embodied society’s desire to give in to its passions and express its feelings. In Blake’s â€Å"The Lamb,† he questioned â€Å"who made thee {lamb}† and then answered â€Å"little lamb God bless thee.† Blake personified the little lamb with â€Å"clothing of delight† and a â€Å"tender voice.† The comparison of the lamb and its creator through imagery and personification characterizes the Romantic Era as a whole.

Doing a budget for my family or even for personal use is not a new experience for me. At a very young age, I was taught by my parents how to wisely manage my money so that I would have something to pull out in case I encounter emergency situations. I carried this on until adulthood and have been making budgets every now and then to make sure that my finances will be enough to cover my bills and other activities that need spending. †¢ What did you learn about credit card debt paying the minimum payment? I have been using credit cards for years now and I just realized, through this activity, that I know very little about the whole process. I thought that paying the minimum payment of my credit card bill will lessen my financial burdens. However, it only made things worse because of the interest it gained every month that I was not able to pay the whole balance. Banks do not properly educate their clients regarding these interests. They expect their clients to understand the terms and conditions that are written at the back of their forms like these contain terms that are easy to understand. †¢ Why is having emergency money in a savings account important? It is important to have emergency money in a savings account because this would mean that a person will have something to pull out when he or she encounters tight situations involving money. A person, even with a planned budget, can inevitably overspend at times. There are also instances when he or she will encounter situations wherein he or she would have to shell out a large amount of money. In these cases, it is always better to have extra money in one’s savings account to avoid the hassle of borrowing from others or from financial institutions. Borrowing from friends or relatives would be easy because they will most likely lend the person the money that he or she needs, at times without even asking any questions. The case would be different in banks because this would require a great deal of process before the load would be approved. In addition, the person would suffer from the interests that the bank will place on him or her, which will depend on how much the loan will be. Instead of making people’s lives easier, loaning from financial institutions can become a nightmare. †¢ What is a credit score? What are the major credit reporting agencies? A credit score is a â€Å"number generated by a mathematical algorithm based on information in a person’s credit report† (Curry, n.d.). This score is used by lending agencies to decide whether to lend the borrower the money that he or she requests or not. It is therefore important to have an ideal credit score. The ideal credit score is about 720 or higher but most people will score 600 to 800 (Curry, n.d.). A good credit score will allow the person to borrow money easily and to have low interest rates. Financial institutions can also use this information to decide whether to increase a person’s interest rate or increase his or her credit limit. There are three major credit reporting agencies and these include Equifax, Experian, and TransUnion. †¢ What can occur if you are a victim of identity theft? â€Å"Identity theft consists of stealing another person’s identifying information and using the information to take money or make purchases† (Bergman, Berman-Barrett, & Berman, 2008, p.293). The sad thing here is that these purchases that thieves would make becomes the responsibility of the victim. Worse, the victim’s reputation will be put to risk because it is his or her name that is being used by the perpetrator. It can take several days or weeks to clear one’s name in companies and establishments, especially in financial institutions because the person would have to prove that his or her identity was stolen. Section Two †¢ During premarital counseling, what can individuals learn about finances? Premarital counseling is important for couples to take before getting married because this would prepare them for the different issues that they may encounter in their married life. One of the many issues that they have to be prepared about is their finances. They will learn how to keep track of their finances. They will learn how to budget and stick to their financial limits so that they do not go overboard. If they own debts at the time of counseling, they will realize that they should pay these off so that they can start clean before getting married. They also need to open a savings plan for rainy days. Also, they need to have a retirement investment fund so that they do not have to worry when the time comes that they need to retire. †¢ How does understanding finances help with a relationship, in particular, within a marriage relationship? One of the major problems that couples face in their married life is their finances. More often than not, this is the cause of divorce or separation. Understanding their finances will help them realize the steps that they need to take in order for them to not experience money troubles. They will realize that they need to work together and not independently to be able to save and have enough money for their family. If they understood their financial status and the things that they have to do in order for them to have a good financial stats, it is most likely that they will also understand each other and have better relationship. †¢ Is it possible for finances to lead a marriage to divorce? As mentioned above, it is possible that financial problems can lead a marriage to divorce. There are times when a person who feels that the other is not exerting enough effort to support the whole family financially will decide that it is better to separate than to live with financial burdens. There are times when money matters are the cause of regular fights, especially if one makes more money than the other. Divorce can happen if couples do not talk about their financial status and try to come up with solutions for their problems. †¢ Do children have an impact on finances? Having children do have an impact on finances as compared to couples living with only the two of them together. Children would mean that the couple would have to budget for clothes, food, toys, education, and other activities to support their growth and development. It would also mean that the couple would have to save in case of emergency like hospital emergencies and the like.

Hunters and social groups relied heavily on the caribou for food, clothing and utensils, as well as a source of culture and spiritual beliefs. When caribou populations declined or migrated, indigenous peoples were forced to either move with the herd, or suffer from severe starvation. Today, the fur trade still takes place in the Canadian north, with roughly 100,000 people in total participating in Canada. Animals, such as the caribou, provide one of the few sources of income available to the natives in some regions, and the natural resources they provide are used to purchase food-stuffs, ammunition, and equipment from the south. The Indian, Inuit, and Dene ethnic groups in Canada all still rely on the caribou as a source of food, despite the fact that native cultures have changed as indigenous peoples have adapted parts of their lifestyle to the new technological advances . The introduction of rifles and snowmobiles into the northern economy have changed hunting and trapping methods, and native people are being forced to continually redefine their own culture as technology filters into the north. There is therefore an increasing need for native people to choose the way in which they interact with southern society, and the blending of traditional skills and modern technology to utilize resources seems to be the most common approach to this problem. Caribou in the northern regions of Canada are fairly plentiful in numbers, and travel in large herds through wide tracts of land in which they can be easily hunted by residents of local communities. Since barren plains caribou are so easily hunted, it is inevitable that they are the favoured meat resource in a renewable resource economy.
